These Terms of Use (“Terms”) govern your access to and use of Apeiros Social (the “Service”), operated by Apeiros Marketing LLC (“Company,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms to use Apeiros Social. By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration

To access the Service, you may be required to create an account. You agree to:

• Provide accurate and complete information

• Maintain the confidentiality of your login credentials

• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain false or misleading information.

3. Description of Service

Apeiros Social is a self-service software-as-a-service (SaaS) platform that allows users to manage, schedule, and publish content across supported social media platforms.

Apeiros Social does not guarantee reach, engagement, follower growth, or performance outcomes.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations

• Infringe upon intellectual property rights

• Post unlawful, harmful, defamatory, or misleading content

• Circumvent platform safeguards or access restrictions

• Interfere with the operation or security of the Service

We reserve the right to investigate and take action against violations, including suspension or termination.

5. Third-Party Platforms

The Service integrates with third-party platforms (such as social media networks). Your use of those platforms is subject to their respective terms and policies.

We are not responsible for:

• Platform outages or API limitations

• Changes to third-party features or permissions

• Account restrictions imposed by third-party platforms

6. Subscription, Billing, and Payments

Apeiros Social is offered on a subscription basis. By subscribing, you agree to:

• Pay all applicable fees associated with your selected plan

• Authorize recurring billing until canceled

• Keep billing information current

All fees are non-refundable unless otherwise stated in writing.

7. Plan Changes and Cancellation

You may upgrade or downgrade your subscription at any time. Changes take effect according to the billing cycle.

You may cancel your subscription through your account dashboard. Cancellation stops future billing but does not retroactively refund prior charges.

8. Intellectual Property

The Service, including software, branding, design, and documentation, is owned by Apeiros Marketing LLC and protected by intellectual property laws.

You retain ownership of content you upload. By using the Service, you grant us a limited, non-exclusive license to process and display your content solely to provide the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use your data. By using the Service, you consent to our data practices.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or factors beyond our control.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available.”
We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Apeiros Marketing LLC shall not be liable for:

• Indirect, incidental, or consequential damages

• Loss of data, profits, or business opportunities

• Actions taken by third-party platforms

Our total liability shall not exceed the amount paid by you for the Service during the prior 12 months.

13. Indemnification

You agree to indemnify and hold harmless Apeiros Marketing LLC from claims arising from:

• Your use of the Service

• Content you post or manage

• Violations of these Terms or applicable laws

14. Termination

We may suspend or terminate your access at our discretion for violations of these Terms or misuse of the Service.

Upon termination, your right to use the Service ends immediately.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
